Notice of Public Meeting To Amend Zoning By-law 19-2019 - September 23, 2025

To amend Township of Alnwick/Haldimand Zoning By-law 19-2019 under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended

 Purpose and Effect of Proposed Amendment:

 The proposed Zoning By-law Amendment will:

  • Amend regulations for bunkhouses to allow farmers to provide housing for farm labour without the need for a Zoning By-law amendment.

  • Remove regulations tied to the gross floor area of secondary dwellings to less than 50% of the gross floor area of the principal dwelling where the secondary dwelling is located within a dwelling. The regulation requiring a minimum lot area of 0.4 ha for a secondary dwelling is proposed to be removed in favour of regulations requiring demonstration of adequate water supply and approval of a sewage disposal system. 

  • Regulations are proposed to be revised to permit the use of shipping containers in the design of a principal or main building where a building permit has been issued. The regulations that permit the use of shipping containers as an accessory structure are proposed to include the Community Facility, Oak Ridges Moraine Core, Oak Ridges Moraine Linkage, and Oak Ridges Moraine Countryside Zones.

  • Remove the regulation restricting expansions of legally existing non-agricultural buildings and structures to a maximum of 100 percent of the ground floor area of the building or structure as of November 15, 2001. This section has been improved to direct single detached dwellings to comply with the regulations for the Rural Residential Zone and all other uses to the regulations for the Rural (RU) zone.  This will ensure additions maintain appropriate yard widths, heights and lot coverages. Based on the above it is appropriate to delete the restriction on floor area for the property located at 8219 County Rd 45 that is zoned ORMCO-1 (within Part Lot 20, Concession 10, Geographic – Haldimand). 

  • Mapping errors are proposed to be corrected. Part Lot 20, Concession 7, Geographic – Alnwick, Roll Number 14502260300385000000.  The zone on this property is incorrectly mapped as Rural Exception No. 88 (RU-88) where the property should be zoned Rural (RU).  The property at 210 Aird Street in Grafton is incorrectly mapped as Hamlet Commercial Exception No. 6 (HC-6) where it should be Hamlet Residential (HR).

 A location map has not been provided as the proposed amendment applies to the entire Township.

Pursuant to Section 34(19) of the Planning Act, R.S.O. 1990, c.P. 13, as amended, only the applicant, the Minister of Municipal Affairs and Housing, or specified persons defined under the Planning Act may appeal the decision to the Ontario Land Tribunal, provided they made oral submissions at a public meeting or written submissions to the council before the by-law is passed. An appeal may not be filed by the general public. 

If a person does not make oral submissions at a public meeting or make written submissions to the Township of Alnwick/Haldimand before the by-law is passed, the person may not be added as a party to the hearing of an appeal before the OLT unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
